1. Agreement
These Terms of Use ("Terms") are an agreement between you and Streamcore Media Inc. ("Streamcore Media", "we", "us", "our"), the publisher of Banaluna. They cover the Banaluna iPhone app, the Banaluna website, and the Banaluna sign-up flow on the web (together, the "Service").
By downloading, subscribing to or using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Service. We recommend you save a copy of these Terms. They will always be available on this page.
2. Who can use Banaluna
You must be at least 18, or the age of majority where you live, to subscribe to and use Banaluna. The Service is made for parents, caregivers and other grown-ups to use with children aged 3 to 12. Children may take part in activities with you, but they shouldn't use the Service on their own.
You're responsible for any use of the Service on your devices and for the information you enter, including information about your children.
3. Subscriptions and payment
Banaluna is available only by paid subscription. The plans, prices and any free trial are shown to you before you buy, and may differ between the App Store and our website, between countries, and over time. You pay the price shown when you subscribe.
Automatic renewal
Your subscription renews automatically at the end of each period, at the then-current price, until you cancel. To avoid being charged for the next period, you must cancel at least 24 hours before it begins.
Free trials
If your plan includes a free trial, you won't be charged until it ends. Unless you cancel at least 24 hours before the trial ends, your paid subscription starts automatically. Free trials are limited to one per person.
Subscriptions bought through the App Store
Apple charges your Apple Account. Manage or cancel your subscription in your iPhone's Settings: tap your name, then Subscriptions. Refunds are handled by Apple under its policies; request one at reportaproblem.apple.com.
Subscriptions bought through our website
Our payment provider charges the payment method you give it. You can cancel at any time using the link in your confirmation email or by emailing support@banaluna.com. When you cancel, you keep access until the end of the period you've already paid for. Refunds are not given for partial periods, except where the law requires them.
Price changes
We may change subscription prices. We'll give you advance notice of any increase as the law and the App Store require, and it will apply from your next renewal. If you don't want to pay the new price, you can cancel before it takes effect.
4. Activity safety
Banaluna's activities are ideas for grown-ups to do with children. Some involve scissors, heat, cooking, food that can cause allergies, small parts, water, balloons or running around.
- Supervise: an adult should supervise every activity. Where an activity notes that an adult should help, the adult should do that part.
- Use your judgement: ages shown are guidance only. You know your children, their abilities and their allergies, so decide whether an activity is right for them and adapt it or skip it if not.
- Check supplies: make sure materials and ingredients are safe and suitable for your children, and keep small parts away from young children.
- Choose a safe space: do physical and outdoor activities somewhere safe and clear.
Content in Banaluna is general information for fun and learning. It isn't medical, nutritional, developmental or professional advice.
5. Your licence to use Banaluna
While your subscription is active and you follow these Terms, we give you a personal, non-exclusive, non-transferable, revocable licence to use Banaluna for your household's non-commercial use. On the App Store, this includes use on Apple devices you own or control, as the App Store's Usage Rules allow, including through Family Sharing where it's enabled.
You agree not to:
- copy, download, record, share, sell or republish Banaluna's videos, guides, images or other content, or use them commercially, for example in a class, a paid service or on social media, without our written permission;
- copy, modify, reverse engineer or try to extract the source code of the app, except where the law allows it;
- get around any access controls or subscription checks, or use the Service in any way that could damage it or interfere with others' use of it;
- use automated tools to access or scrape the Service;
- use the Service unlawfully.
6. Our content
The activities, videos, step-by-step guides, text, images, illustrations, icons, the Banaluna name and logo, and the app itself (the "Content") are owned by Streamcore Media or licensed to us, and are protected by copyright, trademark and other intellectual property laws. Apart from the licence in section 5, these Terms don't give you any rights in the Content.
We work to keep the Content accurate and up to date, but it may occasionally contain errors. We may add, change or remove activities and features at any time.
Intellectual property complaints
If you believe something in the Service infringes your copyright or other rights, email legal@streamcore-media.com. Include a description of the work, where it appears in the Service, your contact details, and a statement that the information you've given is accurate and that you are, or are authorised to act for, the rights owner.
7. Your content and feedback
The notes, ratings and other things you add in Banaluna ("Your Content") belong to you. You give us permission to store, process and display Your Content only as needed to provide the Service to you and, in aggregate, to improve it, as described in our Privacy Policy. We won't publish Your Content.
Please don't add anything unlawful, or other people's personal information beyond what's needed to use Banaluna.
If you send us suggestions or feedback, we may use them to improve Banaluna without any obligation to you.
8. Third-party services and links
The Service relies on third parties such as Apple and payment providers, and may link to other websites. We don't control them and aren't responsible for their content, policies or availability. Your use of them is governed by their own terms.
9. Changes, suspension and termination
We may update these Terms from time to time. We'll post the new version here with a new date and, for significant changes, tell you in the app or by email before they take effect. If you keep using the Service after the changes take effect, you accept them. If you don't agree, you can cancel your subscription.
You can stop using Banaluna at any time. We may suspend or end your access if you seriously or repeatedly break these Terms, or if we have to stop offering the Service. If we discontinue Banaluna while you have a paid subscription, we'll tell you in advance and, for web subscriptions, refund any unused paid period. For App Store subscriptions, Apple handles refunds.
Sections 6, 7, 10, 11, 13 and 14 continue to apply after these Terms end.
10. Disclaimers and limitation of liability
The Service and its Content are provided "as is" and "as available". To the fullest extent permitted by law, Streamcore Media makes no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement, and doesn't promise that the Service will be uninterrupted, error-free or free of harmful components.
To the fullest extent permitted by law, Streamcore Media, its affiliates, and their directors, officers, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, data or goodwill, arising from your use of the Service. This includes injury or damage arising from carrying out an activity, which you do at your own discretion and under your own supervision. Our total liability for any claim relating to the Service is limited to the amount you paid us for Banaluna in the 12 months before the claim.
Some jurisdictions don't allow certain warranties to be excluded or liability to be limited, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited by law, including for death or personal injury caused by our negligence, or for fraud. If you are a consumer, you keep all the rights that consumer law gives you.
11. Indemnity
To the extent permitted by law, you agree to indemnify Streamcore Media and its affiliates against claims, losses and reasonable costs, including legal fees, arising from your breach of these Terms or your misuse of the Service.
12. Apple
If you downloaded Banaluna from the App Store, these terms also apply:
- These Terms are between you and Streamcore Media only, not Apple. Streamcore Media, not Apple, is solely responsible for Banaluna and its content.
- Apple has no obligation to provide maintenance or support for Banaluna.
- If Banaluna fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation for Banaluna.
- Streamcore Media, not Apple, is responsible for addressing any claims relating to Banaluna, including product liability claims, claims that it fails to meet legal or regulatory requirements, and consumer protection claims.
- If a third party claims that Banaluna infringes their intellectual property rights, Streamcore Media, not Apple, is responsible for investigating, defending, settling and discharging that claim.
- You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- You must comply with any applicable third-party terms, such as your mobile carrier's, when using Banaluna.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and, once you accept them, Apple has the right to enforce them against you.
13. Governing law and disputes
These Terms are governed by the laws of the State of South Dakota and, where they apply, the federal laws of the United States, without regard to conflict-of-law rules. Disputes will be decided by the state or federal courts located in South Dakota, unless the law of the country or state where you live gives you the right to bring proceedings in your local courts or to rely on its consumer protection laws.
Before starting any formal proceedings, please contact us at support@banaluna.com so we can try to resolve the issue informally.
14. General
These Terms, together with our Privacy Policy, are the entire agreement between you and us about the Service. If any part of them is found unenforceable, the rest still applies. If we don't enforce a right straight away, we haven't waived it. You may not transfer your rights under these Terms. We may transfer ours to a company that takes over Banaluna. We aren't responsible for delays or failures caused by events beyond our reasonable control.
